Access Agreement

Please read this Agreement carefully before accessing Gogoguns.com classifieds. As a condition to and in consideration of receiving and accessing classifieds at Gogoguns.com, the User agrees to be bound by the terms of this Agreement. Use of or access of Gogoguns.com classifieds shall constitute acceptance of and agreement to be bound by this Agreement. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS GOGOGUNS.COM. Gogoguns.com Access Agreement
This AGREEMENT “Agreement” is entered into by and between Gogoguns.com and any individual, corporation, association, agency, company, or other entity who accesses or uses the Gogoguns.com classifieds (the ‘User” or “you”).

Gogoguns.com classifieds is a World Wide Web site on the Internet that is designed to allow users to post classified ads and/or to view classified ads posted by other Users or interact with those other Users. Gogoguns.com and its owners are independent of any user of Gogoguns.com. Gogoguns.com classifieds contain or may contain information, communications, opinions, text, graphics, links, electronic art, animations, audio, video, software, photos, music, sounds and other material and data (collectively “content”) formatted, organized and collected in a variety of forms that are generally accessible to Users, including directories and databases, and areas of Gogoguns.com that can be modified by Users, such as, but not limited to ad postings.

In addition, by posting your ad with Gogoguns.com, you agree that it is in compliance with our Terms and Conditions as laid out by this Access Agreement. We reserve the right to remove any ads in violation of our Terms and Conditions. All ads that are in violation of our Terms and Conditions are subject to immediate removal without prior notice or justification to the poster or any other User. By posting an ad with Gogoguns.com you agree that you will be solely responsible for the content of all ads that you post on Gogoguns.com. You also agree that you will abide by local, state, and federal laws and how they apply to Users in respect to the content of Gogoguns.com. You agree that the knowledge of those laws is the sole responsibility of you the User. Also, you agree that you will hold this website harmless for any losses or damages to yourself or to others that may result directly or indirectly from any ads that you have posted.

By using the services of Gogoguns.com or by accessing Gogoguns.com you further agree to the following guidelines of the Access Agreement:

1. User Rights and Responsibilities

1(a) Access to Gogoguns.com
You are responsible for providing all hardware, software, telephone or other communication equipment and/or service to connect to the Internet and access Gogoguns.com. You are responsible for all Internet access charges, telephone charges, or other fees or charges incurred in connecting to the Internet and accessing Gogoguns.com.

1(b) User Conduct
You agree to access and use Gogoguns.com for lawful purposes only. You are solely responsible for the knowledge of and adherence to any and all local, state, and federal laws, statutes, and rules and regulations pertaining but not limited to; your use of Gogoguns.com, including any Interactive Area; the use of any networks or other services connected to Gogoguns.com; the means by which you connect your modem, computer, or other equipment to Gogoguns.com. By accessing Gogoguns.com you agree to all of the following:
You will not restrict or inhibit any other User from using and enjoying the interactive features;
You will not post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, indecent, or otherwise offensive information of any kind;
You will not post or transmit any information that would promote or encourage conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, or federal law;
You will not post or transmit any information, software, or other material which violates or infringes on the right of others, including material which is an invasion of privacy or publicity rights, or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder;
You will not post ads that misrepresent the item listed, that are not consistent with the content of Gogoguns.com, that are not in good legal standing, that are considered illegal by any local, state, or federal law, or that are all together fraudulent in means;
You will not post multiple ads for the same item, or post ads that direct visitors to other websites of competitive nature;
You will not post or transmit any information, software, or other material which contains a virus or other harmful components;
You will not alter, damage, or delete any content or communications with the intent to interfere with the ability of others to access and use Gogoguns.com;
You will not claim a relationship with or to speak for any business, association, institution, or other organization for which you are not authorized to claim such a relationship;
You will not violate any operating rule, policy, or guideline of your Internet access provider or online service;
You will not post an ad for fully-automatic firearms, select type firearms, or “silencers;”
You agree that you are 18 years of age or older to access and subsequently use the services provided at Gogoguns.com;
You agree that if accessing and subsequently using the portions of Gogoguns.com that pertain to handguns and handgun ammunitions, you are 21 years of age or older.
You agree to review and abide by the guidelines for posting ads, all local, state, and federal laws, and how they apply to you and/or the user. These guidelines may be reviewed by clicking on the Guidelines and Regulations link.

Intellectual Property Rights

2(a) Gogoguns.com Classifieds Content
You acknowledge that the content on Gogoguns.com is generally provided by Gogogun.com, individual contributors of Content (“Contributors”), third party licensees, and/or other Users. You acknowledge that Gogoguns.com permits access to Content that may be protected by copyrights, trademarks, and other proprietary (including intellectual property) rights, and that these Intellectual Property Rights are valid and protected in all media existing now or later developed, and except as explicitly provided below, your use of Content shall be governed by applicable copyright and other intellectual property laws. You acknowledge that Gogoguns.com owns a copyright in the selection, coordination, arrangement, and presentation of such Content.

You acknowledge that you may not modify, copy, reproduce, transmit, distribute, publish, create derivative works from, display, or otherwise transfer or commercially exploit any of the Content, in whole or in part, provided however, that you may: make a reasonable number of digital or other form of copies to permit your computer hardware and software to access and view the Content; print one copy of each piece of Content; make and distribute a reasonable number of copies of Content, in whole or in part, in hard copy or electronic form for internal use only. Any permitted copies of Content must reproduce in an unmodified form any notices contained in the Content, such as all Intellectual Property Right notices, and an original source attribution to Gogoguns.com and its URL address. You acknowledge that Gogoguns.com, its Contributors, and/or Users remain the owners of the Content and that you do not acquire any Intellectual Property Rights by downloading or printing Content.

2(b) Content Provided by User
You may upload to any Interactive Area or otherwise transmit, post, publish, reproduce or distribute, on or through Gogoguns.com only Content that is not subject to any Intellectual Property Rights, or Content in which any holder of Intellectual Property Rights has given express authorization for distribution over the Internet and on Gogoguns.com without restriction whatsoever. Any Content submitted with the consent of a copyright owner other than you should contain a phrase such as “Copyright owned by [name of owner] or “Used by Permission.” By submitting Content to any Interactive Area, you automatically grant and/or warrant that the owner of such Content, whether it be you or a third party, has expressly granted to Gogoguns.com the royalty free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, sublicense, distribute, perform, and display such Content, in whole or in part, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Intellectual Property Rights that may exist in such Content. You also permit Gogoguns.com to sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to such Content. You also permit any user to access, view, store, and reproduce the Content for personal use.

Interactive Areas
You acknowledge that Gogoguns.com may include various interactive areas (“Interactive Areas”), including but not limited to classified ads. These Interactive Areas allow feedback to Gogoguns.com and real time interaction between Users. You further understand that Gogoguns.com does not control the messages, information, or files delivered between Users in these Interactive Areas. Gogoguns.com and its owners are not responsible for Content within any communications between Users. The communications between Users will be governed by this Agreement. You recognize that Gogoguns.com cannot, and does not intend to screen communications between Users. Moreover, because Gogoguns.com encourages open and candid communication between Users, Gogoguns.com can not determine in advance the accuracy or conformance to this Agreement of any Content transmitted between Users. Gogoguns.com is not responsible for screening, policing, editing, reviewing, or monitoring the Content of any communications between Users. Notwithstanding the above, you agree that Gogoguns.com has the right to monitor any Interactive Area, from time to time and to disclose any information necessary to satisfy any law, regulation, or other governmental request, to operate the Interactive Area, or to protect itself or other Users. If notified of Content that is alleged not to conform to this Agreement, Gogoguns.com may investigate the allegations and determine in its sole discretion whether to remove or request the User to remove such Content. Gogoguns.com reserves the right to prohibit conduct, communication, or Content within an Interactive Area, or to edit, refuse to post, or to remove any Content, in whole or in part, which it deems in its sole discretion to; violate the provisions of this Agreement, or any other Gogoguns.com policy in effect at that time; be harmful to the rights of any User, Gogoguns.com, or other third parties; violate applicable law; or be otherwise questionable. Gogoguns.com reserves the right to remove or edit such content as described above without notice or justification to the User.

Termination
The only right with respect to dissatisfaction with this site, its policies and agreements, guidelines, Content, or any other portion of this site, is for you to discontinue accessing Gogoguns.com. Gogoguns.com and its owners may terminate your User access to this site at any time, without notice, for conduct that Gogoguns.com believes to be a violation of this Agreement, or any policies or guidelines posted by Gogoguns.com, or for conduct which Gogoguns.com believes in its sole discretion harmful to Gogoguns.com or other Users. Gogoguns.com may discontinue operation of this site at any time and terminate this Agreement without notice to you. In the event of the termination of this site, you are no longer authorized to access Gogoguns.com. However, the disclaimers and limitations of liabilities set forth in this Agreement still apply.

You understand that except for the Content available at Gogoguns.com, neither Gogoguns.com, nor its owners, is responsible for any Content, goods, or services available through sites on the Internet linked to or from Gogoguns.com. All such Content, goods, and services are made accessible on the Internet by independent third parties and are not a part of, or controlled by, Gogoguns.com. Gogoguns.com neither endorses nor is responsible for the accuracy, completeness, usefulness, quality, or availability of any Content, goods, or services available on any site linked to or from Gogoguns.com, which are the sole responsibility of such independent third parties, and your use thereof is solely at your own risk. Neither Gogoguns.com nor its owners shall be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by your use of or reliance on any Content, goods, or services available on any site linked to or from Gogoguns.com, or your inability to access the Internet or any site linked to or from Gogoguns.com.

Disclaimers of Warranties
Please use your best judgment in evaluating all information contained on Gogoguns.com. Gogoguns.com is independent of any User, and therefore does not endorse or oppose any Content expressed by a User, Contributor, or other independent party. YOU EXPRESSLY AGREE THAT YOUR USE OF GOGOGUN.COM IS AT YOUR SOLE RISK. NEITHOR GOGOGUNS.COM NOR ANY OF ITS OWNERS, AFFILIATES, OR OTHER SUPPLIERS PROVIDING CONTENT, DATA, INFORMATION OR SERVICES WARRANTS THAT GOGOGUNS.COM OR ANY INTERNET SITE LINKED TO OR FROM GOGOGUNS.COM WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE INCLUDING INTERACTIVE AREAS, OR THE SERVER THAT MAKES IT AVAILABLE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOR DO ANY OF THEM MAKE ANY WARRANTY AS TO: THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF GOGOGUNS.COM; ANY INTERNET SITE LINKED TO OR FROM GOGOGUNS.COM; THE TIMELINESS, SEQUENCE, ACCURACY, AUTHORITY, COMPLETENESS, USEFULNESS, NONINFRINGEMENT, RELIABILITY, AVAILABILITY, OR SUSTANCE OF ANY CONTENT, INFROMATION, SERVICE, OR TRANSACTION PROVIDED THROUGH GOGOGUNS.COM OR ANY SITE LINKED TO OR FROM GOGOGUNS.COM. GOGOGUNS.COM OR ANY SITE LINKED TO OR FROM GOGOGUNS.COM IS PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitations of Liability
IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL GOGOGUNS.COM, ITS OWNERS, NOR ITS AFFILIATES (COLLECTIVELY “INDEMNIFIED PARTIES”) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, EXEMPLARY DAMAGES, OR ANY DAMAGES WHATSOEVER, ARISING FROM OR ANY WAY CONNECTED OR RELATING TO: THIS AGREEMENT, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CUASE OF ACTION, INCLUDING WITHOUT LIMITATION, ANY LIABILITY FOR DAMAGES CAUSED OR ALLEGEDLY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, ELECTRICAL SURGE/DAMAGE/INTERFERENCE, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATIONS, LINE FAILURE, BREAKDOWN OF EQUIPMENT, SOFTWARE ERROR, INFRINGEMENT, UNAUTHORIZED ACCESS TO, OR THEFT, DESTRUCTION, ALTERATION, OR USE OF, RECORDS; GOGUNS.COM IN GENERAL AND ANY TRANSACTION AGREED TO BETWEEN YOU AND USERS ON GOGUNS.COM; ANY INTERNET SITE LINKED TO OR FROM GOGOGUNS.COM; ANY INFORMATION, SERVICES OR PRODUCTS PROVIDED BY THIS SITE; THE USE OF OR INABILITY TO USE THIS SITE; ANY INTERACTION BETWEEN YOU AND OTHER USERS OF GOGOGUNS.COM, EVEN IF ANY OF THE IDEMNIFIED PARTIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES SHALL GOGOGUNS.COM, ITS OWNERS, NOR ITS AFFILIATES BE LIABLE TO YOU OR ANY OTHER THIRD PARTY FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON THE CONTENT CONTAINED WITH GOGOGUNS.COM OR THE CONTENT CONTAINED WITHIN ANY INTERNET SITE LINKED TO OR FROM GOGOGUNS.COM. THE CONTENT WITHIN GOGOGUNS.COM AND THE CONTENT WITHIN INTERNET SITES LINKED TO OR FROM GOGOGUNS.COM MAY INCLUDE TECHNICAL OR OTHER INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE CONTENT HEREIN; THESE CHANGES WILL BE INCORPORATED IN NEW VERSIONS OF GOGOGUNS.COM AND SPECIFICALLY ARE INCLUDED IN THIS AGREEMENT. GOGOGUNS.COM AND ITS CONTRIBUTORS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE CONTENT AT ANY.

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT GOGOGUNS.COM IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE, FRAUDULENT, OR OTHERWISE ILLEGAL CONDUCT OF ANY USER. YOU AGREE TO HOLD HARMLESS THE INDEMNIFIED PARTIES FROM ANY CLAIM OR DEMAND, ICLUDING BUT NOT LIMITED TO ATTORNEY’S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF THIS SITE, THE VIOLATION OF THIS AGREEMENT BY YOU, OR THE INFRINGEMENT BY YOU, OR OTHER USERS OF GOGOGUNS.COM USING YOUR COMPUTER, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY. IF YOU ARE DISSATISFIED WITH ANY GOGOGUNS.COM SITE CONTENT, ACCESS AGREEMENT, POLICIES, OR GUIDELINES, OR ANY OTHER SECTION INCLUDED IN THIS SITE, IN WHOLE OR IN PART, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING GOGOGUNS.COM.

Additional
This Agreement comprises the entire agreement between Gogoguns.com and you, and supersedes any prior agreements with respect to the subject matter herein. Gogoguns.com may revise this Agreement or any other policy at any time and such revisions shall be effective immediately upon notice. You agree to review this agreement periodically to be aware of such revisions. If any such revisions are unacceptable to you, your only recourse of action is to discontinue use of Gogoguns.com. Your continued use of Gogoguns.com following any revisions shall conclusively be deemed acceptance of all such revisions. The provisions outlined in the above Agreement shall survive the termination or expiration of this Agreement. If any provisions of this Agreement or any other policy be held invalid or unenforceable, that portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intention of the parties and the remaining portions will continue in to be in effect. The failure of Gogoguns.com to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. This agreement shall be governed by the state and/or the federal courts located in the Great State of Tennessee.
